These terms and conditions form the basis on which you can visit and use our website. By placing an order the customer agrees to abide by these terms and conditions. Ownership of rights All rights, including copyright, in this website are owned by or licensed to Dutch Garden World. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose. Accuracy of Content We have taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. If the price of the goods increases between the date we accept your order and the delivery date, we will let you know and ask you to confirm by e mail that the new price is acceptable. If it is not acceptable, then you will of course have the right to cancel your order. Any weights, dimensions and capacities given about the goods are approximate only. To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website and we shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials contained on this website. Damage to your computer We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer: It is your responsibility to ensure that the right equipment is available to use the website. We will not be liable to any person for any loss or damage which may arrise to computer equipment as a result of using this website. Availability All items are subject to availability. Because we are dealing with living bulbs, availability is dependent on harvest results. In spite of careful planning, it is possible that a variety may not be available at the time of despatch. If this is the case we will send you an equivalent alternative which will be of equal quality for optimum flowering. Ordering errors You are able to correct orders on your order up to the point on which you click on 'submit' during the ordering process. Payment terms We will charge your credit account for payment upon receipt of your order. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain a full payment for the goods from your account then we can cancel the contract and or suspend any further deliveries to you. This does not affect any other rights we may have. Delivery charges All prices include shipping costs with the exception of the following: Orders less than €35.- for delivery to the Netherlands we will charge a carriage contribution of €6.50. Orders less than €40.- for delivery to Belgium, Germany and other members of the EU we will charge a carriage contribution as follows: Belgium €6.50 Germany €10.00 And for all other countries which are members of the EU €15.00 Orders less than €55.00 for delivery to USA/Canada and other non-members of the EU the carriage contribution will be charged at €20.00. Switzerland and Norway National Swiss and Norwegian duties and taxes are NOT included in above prices. Delivery We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions. We will deliver the order at the correct planting time, but exact dates are not guaranteed. Risk and owndership Risk of damage to or loss of the goods passes to you at the time of delivery, or the attempted delivery. Transfer of ownership will take place once the goods have been delivered and we have received clear payment in full. Acknowledgement and acceptance of your order You will need to provide us with your e-mail address and we will notify you by e mail as soon as possible to confirm receipt of your order. An acceptance of your order will take place on despatch of the goods ordered. We reserve the right to refuse an order, and should we deem it necessary to do so, we will notify you within ten (10) working days. Cancellation rights Because we are dealing with live product, we will only accept cancellation of an order within 7 days of the order being placed, providing the goods have not already been despatched. Liability & Responsibility Waling van Geest Netherlands BV cannot be held responsible for negative impact of injudicious, improper or incorrect use or abuse of goods supplied. It is your responsibility to examine the goods at the time of delivery. Any queries or complaints must be made in writing within two (2) days of delivery to our e mail address at info@dutchgardenworld.com. Where it is necessary to compensate for loss or poor quality, we will never re-imburse more than the actual costs involved. Changes to legal notices We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible. Law, jurisdiction and language This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with Dutch law. The relevance of the Viennese Purchase Treaty is excluded. If a satisfactory agreement to any dispute cannot be resolved directly betweeen Dutch Garden World and you, the customer, agree to submit to the exclusive jurisdiction of the courts. Conditions voucher (e-voucher) 1. This e-voucher is personal by name, not transferable and free to spend in the webshop of Dutch Garden World. 2. Every e-voucher has a unique code. Each e-voucher will only be provided once. You will need to carefully keep the code. In case of theft (including the use of the code by unauthorized 3rd parties) or loss (including (accidentally) deleting e-mails or text messages) there will be no restitution. 3. The validation of the e-voucher is 12 months after issue. 4. The e-voucher or the remainder of the amount is not exchangeable for cash. 5. The e-voucher cannot be used for outstanding orders. 6. It is not allowed to change the gift voucher or it’s function, falsify, undermine or affect otherwise (including hacking). 7. Every attempt of fraud or other not permitted action will be registered and will lead to deny the use of the gift voucher.  Registration Chamber of Commerce Van Geest Nurseries B.V. acting under the name of Dutch Garden World is registered at the Chamber of Commerce Rijnland under number 28089074.
